Scope of application of the GCU

These general conditions of use (“GCU”) apply to all visits to the Site, irrespective of the Creation of a Customer Account, defined below, by the user to place product orders.
If the user does not create a Customer Account, he will be deemed to have accepted the GCU by simply browsing the Site.
If the user creates a Customer Account, he will be deemed to have expressly accepted the GCU when creating the Customer Account.

Acceptance of the GCU

  1. The GCU will also be communicated to the user when creating the account (“Customer Account”). It is therefore essential that the user reads and understands the GCU in their entirety.
    The user acknowledges that he will not be able to access the Site’s services without unreservedly accepting these GCU, and he undertakes to comply with them.
    The GCU must be expressly accepted by the user when the Customer Account is created.
    The GCU must be accepted by the user’s legal representative or any person duly authorised by the legal representative.The GCU govern the terms of access and use of the Site for all visits to the Site, whether simple visits or to place orders of products, it being specified that the general conditions of sale which must be accepted by the user when orders are placed will govern product orders.
    The GCU prevail over all other user documents. The GCU contain all the terms and conditions that the user and FILLON TECHNOLOGIES have agreed upon and replace all documents, prior agreements and communications, including all verbal or other proposals, with the exception of the general conditions of sale.
    FILLON TECHNOLOGIES reserves the right to modify the GCU at any time by publishing a new version on the Site or sending users a notification by email.
    Users must read the new GCU, it being specified that the user can terminate his Customer Account in case of disagreement on these new GCU. The placing of an order by the user after the notification will constitute his acceptance of these new GCU.

Creation of the Customer Account

The creation of a Customer Account is required to be able to place a product order. The Customer Account must be created by the user’s legal representative or any other person authorised by him. The user must provide the following exhaustive information:

– Concerning the individual using the Customer Account: surname, first name, email address, telephone number.
– Concerning the user company: company name, SIRET number, VAT number, address of the registered office.
The user vouches for the acceptance and observance of the GCU by the individual authorised to create and use the Customer Account.
The email address communicated must remain valid for as long as the Customer Account exists.
An email confirming creation of the Customer Account will be automatically sent to the address indicated.
The information mentioned above by the user must be accurate, truthful, up to date and complete. In case of change, the user undertakes to update this information to maintain its accuracy.
Fillon Technologies disclaims any liability for any loss of information accessible in the Customer Account. The user must save a copy and cannot claim any compensation in this respect.
The Customer Account created cannot place an order before its validation by Fillon Technologies. The user will be notified by email when the Customer Account is validated.

Access to the Site

The user acknowledges having the necessary skills and means to access the Site and use it.
Access to the Site and its use requires having the following minimum requirements:
– a connection to the Internet, it being recalled that the quality of access to the Site and placing product orders depends on this connection, which the user is responsible for.
– a recent version of one of the following browsers: Chrome, Firefox, Internet Explorer, Safari

Personal Data – Information technology & freedoms

FILLON TECHNOLOGIES undertakes to ensure that the collection and processing of personal data, carried out from the Site, complies with the provisions of the General Data Protection Regulation (GDPR – EU Regulation 2016/679 of April 27, 2016) and the French Data Protection Act (Law No. 78-17 of 06/01/1978).

 

a) Data collected

FILLON TECHNOLOGIES collects information concerning the user when the Customer Account is created. FILLON TECHNOLOGIES collects and processes the following categories of personal data (hereinafter the “Personal Data”):

  • Civil status,
  • Identity,
  • Identification data,
  • Connection data (IP address, identifiers).

Information marked with an asterisk is mandatory.

FILLON TECHNOLOGIES will not collect and will not directly or indirectly process any personal data relating to the race, health, sexual orientations, political, philosophical or religious opinions of users.

b) Purposes of the processing

The processing of Personal Data by FILLON TECHNOLOGIES is intended to satisfy its legal interests in pursuit of the purposes set out below. The Personal Data collected allows FILLON TECHNOLOGIES to process orders placed by the Customer, perform operations relating to Customer management, prospecting, development of sales statistics, management of requests for access rights, management of requests concerning the right of access, rectification and opposition, management of outstanding payments and disputes, management of promotional operations and management of reviews. This data may be used by FILLON TECHNOLOGIES to send information and promotional offers.

c) Retention of Personal Data

Personal Data is hosted by FILLON TECHNOLOGIES. FILLON TECHNOLOGIES will implement all appropriate measures to guarantee a suitable level of security to ensure the protection of the Personal Data of the persons concerned and to limit the risks of loss, deterioration or misuse of Personal Data. However, FILLON TECHNOLOGIES cannot guarantee that unauthorised third parties will not be able to bypass the security system put in place, to use said personal data for unauthorised purposes. If FILLON TECHNOLOGIES finds the existence of a security breach, it will notify said breach to the CNIL, at the latest within 72 hours after discovering the breach.

Personal Data is kept for a period of one (1) year starting to run from the deletion of the Customer Account. In accordance with the regulations, the personal data retention period may not exceed that required for the purposes of its processing.

d) Communication of Personal Data

Personal Data may be communicated to third parties located in the European Union in the following cases:

– when the user uses payment services, for the implementation of these services, the Site is in relation with third-party banking and financial institutions with which it has contracts,

– when the Site uses service providers to provide user support, advertising and payment services. These service providers have limited access to the user’s data, within the framework of the performance of these services, and have a contractual obligation to use it in accordance with the provisions of the applicable data protection regulations,

– if required by law, the Site may transmit Personal Data to respond to claims against the Site, comply with administrative and judicial decisions and procedures and defend its rights and interests.

In other cases, Personal Data cannot be communicated to third parties without the express agreement of the user.

e) Right of access, rectification, deletion, opposition, portability

In accordance with the regulations in force, the user has at all times a right of access, communication, rectification, updating, portability, opposition and deletion of Personal Data concerning him. Intellectual Property – Copyrights

FILLON TECHNOLOGIES holds all copyrights related to the Site.
The Site, in particular its content, texts, still or moving images, databases, programs and generally all visual elements including the trademarks and logos in the Site, whether or not registered as a trademark or otherwise, and the presentation and content of all documents appearing on the Site, is the exclusive property of FILLON TECHNOLOGIES or of third parties with whom it has concluded agreements allowing their dissemination.

The trademarks and logos appearing on this site are trademarks registered by FILLON TECHNOLOGIES or third parties. Their mention in no way grants a licence or any right of use on said trademarks and logos which therefore cannot be used without the prior written consent of the owner of the trademark and logos, subject to prosecution for infringement.

No element of the Site, of any nature whatsoever (texts, images, videos, etc.), including trademarks and logos, can be reproduced, used, modified, extracted and/or copied in whole or in part, in any form and for any reason whatsoever, free or against payment, without the prior written agreement of FILLON TECHNOLOGIES.
